Citing a clause in the state constitution that has been ignored and watered down by state lawmakers over the years, the lawsuit, filed in Hackensack, claims Gov. Jon S. Corzine and the Legislature's attempt to restart school construction with borrowing can't proceed without voter approval. It "is void and inoperable unless or until it is submitted to and approved by the voters of New Jersey as required," the lawsuit says. Corzine, who has pledged to rein in borrowing without voter approval, has excepted this measure because he has linked repayment of the debt to an existing revenue -- the state income tax -- and because the state is under court orders to build new schools. Lonegan, the former mayor of Bogota who once ran for the Republican nomination for governor and now heads the New Jersey chapter of Americans for Prosperity, said the suit is only about the people's right to vote and the state's finances. "This is a total drag on our state's fiscal future and our economy," Lonegan said. Corzine spokesman Sean Darcy had no immediate comment. The state plans to use $2.9 billion of the funding to build 53 projects in the 31 districts covered by the Abbott vs. Burke school funding litigation. The remaining $1 billion will be distributed as grants to other districts and county-vocational schools whose projects are eligible for partial funding. |
